Terms & Conditions

These terms apply to services provided by Harvey Trades Pty Ltd, trading as Harvey Trades.

Promotions & Discounts

The following conditions apply to all discounts and promotional offers advertised on this website.

  • Discounts apply to Harvey Trades' standard rates and are calculated on the total invoice.
  • Offers cannot be combined. Where more than one applies, you'll receive whichever discount is worth more.
  • The $50 online booking offer requires a minimum spend of $300 and applies to jobs booked through our website, or by phone quoting WEB50.
  • Seniors, pensioner, Defence Force and DVA discounts are capped at $500 per job and require a valid card to be sighted on site.
  • One discount per household, per job.
  • Discounts must be claimed at the time of booking. They cannot be applied retrospectively once work is complete or an invoice has been issued.
  • Offers exclude third-party parts and equipment supplied at cost.
  • Harvey Trades may vary or withdraw these offers at any time. Jobs already booked are unaffected.

1. Acceptance of Terms

By accepting a quotation, booking a service, requesting attendance, or authorising Harvey Trades to commence work, the Client agrees to these Terms & Conditions.

Acceptance may be provided verbally, in writing, by email, SMS, digital acceptance through our quoting software, or by permitting Harvey Trades to commence work.

These Terms apply to all plumbing, gas fitting, drainage, heating, cooling, irrigation and related services supplied by Harvey Trades.

2. Assessment & Attendance Fees

Harvey Trades charges an Assessment Fee to attend site, inspect the reported issue and provide professional advice.

The Assessment Fee includes:

  • Travel to and from site.
  • Up to 15 minutes of assessment and diagnosis.
  • Discussion of repair or replacement options.
  • Preparation of an on-site quotation where reasonably possible.

Current Assessment Fees are:

  • Standard Assessment Fee: $99
  • After Hours Assessment Fee: $149
  • Emergency Assessment Fee: $299

Assessment Fees are payable once attendance has occurred and are non-refundable.

At Harvey Trades' sole discretion, the Assessment Fee may be waived where the Client proceeds immediately with the quoted works.

Should further investigation, dismantling, specialised testing or fault-finding be required beyond the initial assessment period, additional diagnostic charges will apply after client approval.

3. Quotations

Unless otherwise stated, quotations remain valid for 30 days.

All quotations are based on the information available at the time of inspection.

Hidden defects, concealed damage, non-compliant installations or unforeseen site conditions may require additional work.

Where additional work is required, Harvey Trades will provide a revised quotation or variation before proceeding unless immediate action is required to make the installation safe or prevent further property damage.

4. Variations

The quoted price includes only the work specifically described within the quotation.

Any additional work requested by the Client, or required due to unforeseen circumstances, shall constitute a variation and may incur additional charges.

Variations will only proceed following client approval unless emergency action is necessary for safety reasons.

5. Payment Terms

Unless otherwise agreed in writing:

  • Payment is due immediately upon completion of works.
  • Progress payments may be required for projects extending beyond one day.
  • Deposits may be required for special-order materials or larger projects.

Harvey Trades reserves the right to suspend work where invoices become overdue.

Overdue accounts may incur interest, administration fees and debt recovery costs where permitted by law.

The Client agrees to pay all reasonable costs incurred recovering unpaid accounts.

6. Ownership of Goods

All goods, materials and equipment supplied remain the property of Harvey Trades until paid for in full.

Harvey Trades reserves all rights available under Australian law to recover unpaid goods where legally permitted.

7. Access to Property

The Client must provide:

  • Safe and unrestricted access.
  • Adequate working space.
  • Safe parking where reasonably available.
  • Access to electricity and water where required.

If Harvey Trades cannot safely access the work area, work may be postponed and additional attendance charges may apply.

The Client is responsible for securing pets and ensuring children remain clear of work areas.

Where authorised, Harvey Trades may attend unattended properties.

8. Existing Installations & Hidden Defects

Harvey Trades is not responsible for faults resulting from:

  • Age-related deterioration.
  • Corrosion.
  • Rust.
  • Wear and tear.
  • Previous workmanship.
  • Non-compliant installations.
  • Existing damage.
  • Structural movement.
  • Tree root intrusion.
  • Blocked or deteriorated pipework.

Repairs may expose additional faults that were not visible during the initial inspection.

The Client acknowledges that hidden defects cannot always be identified prior to commencing work.

9. Diagnostic Authority

Certain faults cannot be accurately diagnosed through a visual inspection alone.

Additional diagnostic procedures may include:

  • Electrical testing.
  • Gas pressure testing.
  • Refrigerant recovery and testing.
  • Isolation testing.
  • CCTV drain inspections.
  • Hydrostatic testing.
  • Excavation.
  • Removal of fixtures.
  • Partial dismantling of equipment.

These services are not included within the initial Assessment Fee unless specifically stated.

Harvey Trades will advise the Client of any additional charges before proceeding.

Diagnostic work remains chargeable regardless of whether repairs proceed.

10. Drainage Services

Drain clearing removes the blockage present at the time of service only.

Harvey Trades cannot guarantee future blockages will not occur.

Recurring blockages may result from:

  • Tree roots.
  • Collapsed drains.
  • Pipe damage.
  • Structural defects.
  • Incorrect pipe grades.
  • Ground movement.

Drain cleaning does not constitute permanent repair of defective drainage systems.

11. Plumbing, Gas & HVAC Services

All work will be carried out in accordance with applicable Australian Standards and relevant legislation.

Where existing installations are found to be unsafe or non-compliant, Harvey Trades may decline to reconnect, recommission or certify equipment until it has been made safe.

Air conditioning and heating systems may contain multiple faults.

Repairing one fault does not guarantee additional faults do not exist or will not become evident during testing or future operation.

12. Parts Availability

Replacement parts are subject to supplier availability.

Quoted prices are based on supplier pricing available at the time of quotation.

Harvey Trades reserves the right to revise quotations where supplier pricing changes occur before materials are ordered.

Equivalent or superior products may be recommended where original products become unavailable.

13. Workmanship Warranty

Harvey Trades provides a 12-month workmanship warranty unless otherwise stated.

Manufacturer warranties remain the responsibility of the product manufacturer.

The workmanship warranty does not apply where:

  • Temporary repairs were requested.
  • Recommended repairs were declined.
  • Another person alters or interferes with the completed work.
  • Equipment has been misused.
  • Lack of maintenance contributes to failure.
  • Damage results from storms, flooding, vermin, power surges or events beyond Harvey Trades’ control.
  • Existing defects cause recurring failures.

Warranty claims must be reported promptly.

Harvey Trades must be given the first reasonable opportunity to inspect and rectify any workmanship issue before another contractor is engaged.

Harvey Trades will not be responsible for costs incurred where another contractor completes repairs without prior written approval.

The Harvey Trades Lifetime Workmanship Warranty applies to eligible workmanship completed by Harvey Trades while the customer holds an active Harvey Platinum membership. The Lifetime Workmanship Warranty remains valid only while the membership is continuously maintained. If the membership expires, is cancelled or is not renewed, the Lifetime Workmanship Warranty benefit ends and the workmanship warranty reverts to the standard warranty applicable to the original works.

14. Site Conditions

Reasonable care will be taken to minimise dust, debris and disruption.

Certain works including drilling, cutting, hydro jetting, excavation and demolition may create dust, noise or vibration.

Clients are responsible for protecting or removing furniture, valuables and fragile items prior to commencement.

15. Hazardous Materials

The Client must notify Harvey Trades if the property contains or is suspected of containing:

  • Asbestos.
  • Lead paint.
  • Mould.
  • Hazardous chemicals.
  • Biological hazards.
  • Contaminated water.
  • Other dangerous materials.

Harvey Trades reserves the right to suspend works until hazardous materials have been safely managed.

Additional costs arising from hazardous materials shall be payable by the Client.

16. Disposal of Materials

Unless otherwise agreed, all removed materials become the property of Harvey Trades and will be disposed of appropriately.

Clients wishing to retain removed items must advise before works commence.

17. Client Responsibilities

The Client agrees to:

  • Provide accurate information.
  • Ensure safe site conditions.
  • Obtain any required approvals unless included within the quotation.
  • Inspect completed work where reasonably possible.
  • Notify Harvey Trades of any concerns within 14 days of becoming aware of an issue.

18. Limitation of Liability

To the fullest extent permitted by law, Harvey Trades shall not be liable for:

  • Pre-existing defects.
  • Hidden damage.
  • Consequential loss.
  • Loss of profits.
  • Existing structural failures.
  • Damage caused by client misuse.
  • Supplier delays.
  • Utility interruptions.
  • Weather delays.
  • Events beyond Harvey Trades' reasonable control.

Nothing in these Terms excludes any rights available under the Australian Consumer Law.

19. Cancellation & Rescheduling

Bookings cancelled within 24 hours of the scheduled appointment may incur a cancellation fee.

Where Harvey Trades has already attended site, the applicable Assessment Fee remains payable.

Repeated cancellations or missed appointments may require prepayment before future bookings.

20. Force Majeure

Harvey Trades shall not be liable for delays or failure to perform services resulting from circumstances beyond its reasonable control including severe weather, natural disasters, supplier shortages, transport delays, industrial action, government restrictions or utility failures.

21. Photography

Harvey Trades may take photographs before, during and after works for:

  • Job records.
  • Warranty records.
  • Insurance purposes.
  • Quality assurance.
  • Training.

No identifiable personal information will be published without the Client's consent.

22. Communication & Marketing

The Client consents to Harvey Trades contacting them by phone, SMS and email regarding:

  • Bookings.
  • Arrival notifications.
  • Quotations.
  • Invoices.
  • Receipts.
  • Warranty matters.
  • Service reminders.
  • Maintenance notifications.

The Client may opt out of marketing communications at any time.

Operational communications relating to active jobs cannot be opted out of.

Harvey Trades will never sell or disclose Client information for third-party marketing purposes.

23. Dispute Resolution

If the Client has concerns regarding completed works, they agree to notify Harvey Trades in writing within 14 days of becoming aware of the issue.

Harvey Trades will be provided a reasonable opportunity to inspect and rectify any workmanship issue before another contractor is engaged.

Both parties agree to make genuine attempts to resolve disputes through open communication before commencing legal proceedings.

24. Governing Law

These Terms & Conditions are governed by the laws of South Australia.

Any dispute arising under these Terms shall be subject to the jurisdiction of the courts of South Australia.

25. Australian Consumer Law

Nothing contained within these Terms excludes, restricts or modifies any rights or guarantees that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law.

Acceptance

Payment is strictly due upon completion of works unless otherwise agreed in writing. By accepting a quotation or authorising Harvey Trades to commence work, the Client acknowledges that they have read, understood and agree to these Terms & Conditions.
